This Personal Data Privacy Policy (hereinafter, the “Privacy Policy”) has been developed to ensure transparency in matters related to personal data processing, to protect the rights and freedoms of personal data subjects, and to comply with the requirements of the legislation of the Russian Federation in the field of personal data protection. 1. DEFINITION OF TERMS
1.1. The following terms are used in this Privacy Policy:
1.1.1. “Website Administration of the Online Platform” (hereinafter, the “Website Administration”) means authorized employees responsible for managing the website, acting on behalf of Iskusstvo Clinic (“DZHERAL” LLC), who organize and/or carry out the processing of personal data, and who also determine the purposes of personal data processing, the composition of personal data subject to processing, and the actions (operations) performed with personal data.
1.1.2. “Personal Data” means any information relating directly or indirectly to an identified or identifiable individual (personal data subject).
1.1.3. “Processing of Personal Data” means any action (operation) or set of actions (operations) performed with or without automation tools on personal data, including collection, recording, systematization, accumulation, storage, clarification (updating, modification), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, and destruction of personal data.
1.1.4. “Confidentiality of Personal Data” means a mandatory requirement for the Operator or any other person who has gained access to personal data not to allow its dissemination without the consent of the personal data subject or other lawful grounds.
1.1.5. “Personal Data Subject” means an individual to whom personal data relates, as well as persons having the right of access to such data in accordance with the legislation of the Russian Federation.
1.1.5. “User of the Website / Online Platform” (hereinafter, the “User”) means a person who has access to the Website via the Internet and uses the Website (online platform).
1.1.6. “Cookies” means a small piece of data sent by a web server and stored on the user’s computer, which the web client or web browser sends back to the web server in an HTTP request each time the user attempts to open a page of the relevant website.
1.1.7. “IP address” means a unique network address of a node in a computer network built using the IP protocol.
2. GENERAL PROVISIONS
2.1. Use of the Website (online platform) by the User means acceptance of this Privacy Policy and the terms of processing the User’s personal data.
2.2. If the User disagrees with the terms of this Privacy Policy, the User must stop using the website / online platform.

3. SUBJECT OF THE PRIVACY POLICY
3.1. This Privacy Policy establishes the obligations of the Website Administration regarding non-disclosure and ensuring the protection regime for the confidentiality of personal data that the User provides at the request of the Website Administration when placing an order to receive a Service. The Website Administration takes all necessary measures to protect personal data, including encryption, restricting access to data, and regular checks of security systems.
3.2. Personal data permitted to be processed under this Privacy Policy is provided by the User by filling out the registration form on the Website (online platform) and includes the following information:

3.2.2. the User’s contact telephone number;
3.2.3. email address (e-mail);
3.2.4. the User’s address.
3.3. The online platform protects data automatically transmitted during the viewing of advertising blocks and while visiting pages on which a system statistics script (“pixel”) is installed, including: IP address; information from Cookies; information about the browser (or other software used to access advertising displays); access time; the address of the page on which the advertising block is located; and the “referrer” (address of the previous page).
3.3.1. Disabling Cookies may result in the inability to access parts of the Website (online platform) that require authorization.
3.3.2. The online platform collects statistics on the IP addresses of its Users (visitors). This information is used to identify and resolve technical issues and to monitor the lawfulness of operations carried out.
3.4. Any other personal information not specified above (history of actions, browsers and operating systems used, etc.) is subject to secure storage and non-disclosure, except as provided in Clauses 5.2 and 5.3 of this Privacy Policy.
4. PURPOSES OF COLLECTING THE USER’S PERSONAL INFORMATION

5. METHODS AND TIMEFRAMES FOR PROCESSING PERSONAL INFORMATION
5.1. The User’s personal data shall be processed by any lawful means, including in personal data information systems, with or without the use of automation tools. Personal data shall be stored no longer than necessary to achieve the purposes of processing, but for no more than 3 (three) years from the date of collection, unless otherwise provided by the legislation of the Russian Federation.
5.2. The User agrees that the Website Administration (online platform) has the right to transfer personal data to third parties, in particular telecommunications operators, and to send SMS messages to the contact telephone number provided by the User, solely for the purpose of fulfilling the User’s order placed on the Website (online platform) of Iskusstvo Clinic.
5.3. The User’s personal data may be transferred to authorized state authorities of the Russian Federation only on the grounds and in the manner established by the legislation of the Russian Federation.
5.4. In the event of loss or disclosure of personal data, the Website Administration (online platform) shall inform the User of such loss or disclosure.
5.5. The Website Administration (online platform) shall take the necessary organizational and technical measures to protect the User’s personal information from unlawful or accidental access, destruction, alteration, blocking, copying, dissemination, as well as from other unlawful actions of third parties.
5.6. The Website Administration (online platform), together with the User, shall take all necessary measures to prevent losses or other negative consequences caused by the loss or disclosure of the User’s personal data.
5.7. Personal data may be provided by Users to the Website Administration (online platform) through various communication channels, including but not limited to feedback forms on the Website (online platform), email, as well as by exchanging messages in messengers (including but not limited to VK, jivo, etc.). The Website Administration (online platform) undertakes to ensure the confidentiality and security of personal data received by the methods specified in this clause in accordance with this Privacy Policy and the current legislation of the Russian Federation.
5.8. When collecting personal data through messengers, the Website Administration (online platform) obtains the consent of the personal data subject to process their data in accordance with the requirements of the legislation of the Russian Federation. Consent may be expressed by sending an appropriate confirmation in response to a request or by performing implied actions, if this is expressly provided for and informed.
6. OBLIGATIONS OF THE PARTIES
6.1. The User shall:
6.1.1. Provide information on personal data necessary for using the Website (online platform).
6.1.2. Update and supplement the provided information on personal data in the event of any changes to such information.
6.2. The Website Administration (online platform) shall:
6.2.1. Use the received information exclusively for the purposes specified in Section 4 of this Privacy Policy.
6.2.2. Ensure that confidential information is kept secret, not disclose it without the User’s prior written consent, and not sell, exchange, publish, or otherwise disclose the User’s transferred personal data, except as provided in Clauses 5.2 and 5.3 of this Privacy Policy.
6.2.3. Take precautionary measures to protect the confidentiality of the User’s personal data in accordance with the procedure commonly used to protect this kind of information in existing business practice.
6.2.4. Block personal data relating to the relevant User from the moment of the User’s request, or the request of the User’s legal representative, or the authorized body for the protection of the rights of personal data subjects, for the period of verification, in the event that inaccurate personal data or unlawful actions are identified.
7. LIABILITY OF THE PARTIES
7.1. The Website Administration (online platform) that has failed to perform its obligations shall be liable for losses incurred by the User in connection with the unlawful use of personal data, in accordance with the legislation of the Russian Federation, except in the cases provided for in Clauses 5.2, 5.3, and 7.2 of this Privacy Policy.
7.2. In the event of loss or disclosure of Confidential Information, the Website Administration (online platform) shall not be liable if such confidential information:
7.2.1. Became public domain before its loss or disclosure.
7.2.2. Was received from a third party before it was received by the Website Administration (online platform).
7.2.3. Was disclosed with the User’s consent.
7.3. In the event of a breach of obligations, the Parties shall be liable in accordance with the current legislation of the Russian Federation.
8. DISPUTE RESOLUTION
8.1. Before filing a claim in court regarding disputes arising out of the relationship between the User and the Website Administration (online platform), it is mandatory to submit a claim (a written proposal for voluntary settlement of the dispute).
8.2. The recipient of the claim shall, within 30 calendar days from the date of receipt of the claim, notify the claimant in writing of the results of the review of the claim.
8.3. If no agreement is reached, the dispute shall be referred to a judicial authority in accordance with the current legislation of the Russian Federation.
8.4. This Privacy Policy and the relations between the User and the Website Administration (online platform) shall be governed by the current legislation of the Russian Federation.
9. ADDITIONAL TERMS
9.1. The Website Administration (online platform) has the right to make changes to this Privacy Policy without the User’s consent.
9.2. The new Privacy Policy shall come into force from the moment it is posted on the Website (online platform), unless otherwise provided by the new version of the Privacy Policy.
